Public information shows that in July 2018, Ningxia Rujigou Anthracite Coal Branch reported coal theft to the Shizuishan Public Security Bureau. During the investigation process, 60 individuals including Xiao Yongsheng and Xiao Fei were involved in a criminal case that surfaced. On May 5, 2019, the Shizuishan Public Security Bureau filed a case against the family criminal group led by Xiao Yongsheng and Xiao Fei, who were suspected of organizing, leading and participating in the crime of criminal organization.
According to the disclosure of the China Discipline Inspection and Supervision magazine, after interrogation, the individuals involved confessed to their involvement in criminal activities, and a small number of party and government organs and state-owned enterprise party members and cadres who acted as "protective umbrellas" entered the sight of the discipline inspection and supervision organs.
On May 19, 2020, 60 people including Xiao Yongsheng organized, led and participated in the first trial of the criminal organization case. This case was the largest criminal case involving the largest number of people and the largest amount of money in Ningxia at that time. More than 1400 assets involved in the case were seized, seized, and frozen, equivalent to approximately 400 million yuan.
On May 19th, the Intermediate People's Court of Shizuishan City publicly announced the first instance verdict of 60 defendants, including Xiao Yongsheng and Xiao Fei, in a criminal case through remote video connection in accordance with the law.
The Shizuishan Intermediate People's Court sentenced Xiao Yongsheng, the defendant, to life imprisonment, deprivation of political rights for life and confiscation of all personal property for the crimes of organizing and leading criminal organization, theft, illegal mining, and provoking trouble; The defendant Xiao Fei was sentenced to 23 years' imprisonment, five years' deprivation of political rights and confiscation of all personal property for the crime of organizing and leading criminal organization like organizations, theft, illegal mining and bribery; The remaining 58 defendants were sentenced to imprisonment ranging from 19 years and 6 months to 2 years and 6 months, respectively.
After the first instance verdict, the defendant Xiao Yongsheng and others appealed. After the second trial, the Ningxia High Court found that the facts determined in the original judgment were clear, the evidence was true and sufficient, the conviction was accurate, the sentencing was appropriate, the application of the law was correct, and the trial procedure was legal. Therefore, it made a rejection appeal in accordance with the law and upheld the final ruling of the original judgment.
