Wang Jianwu, former member of the Party Committee and deputy director of the Public Security Bureau in Zhenxiong County, Zhaotong City, Yunnan Province, was charged with bribery and dereliction of duty. After the first trial verdict was pronounced, he was remanded for retrial. During the retrial, after being recommended by the prosecution to postpone the trial, the trial has now resumed.
Wang Jianwu has been working as a police officer for 20 years and has been working on the front lines of anti crime and criminal investigation. On July 2, 2020, he was taken away from his office by personnel from the Zhenxiong County Commission for Discipline Inspection and Supervision. On the same day, he was detained on suspicion of serious violations of duty. On October 25 of the same year, he was criminally detained on suspicion of abuse of power, dereliction of duty, and bribery.
On September 13, 2021, the Suijiang County Court in Zhaotong City announced in the first instance that Wang Jianwu was found guilty of bribery and dereliction of duty. He was sentenced to seven years in prison and fined 200000 yuan.
After the verdict was pronounced, Wang Jianwu appealed against it. On December 28, 2022, the Intermediate People's Court of Zhaotong City ruled that some of the facts determined in the original judgment were unclear and the evidence was insufficient. The original judgment was revoked and remanded to the Suijiang County Court for retrial.
During this period, Qin Xiaoling, the former director of the Third Discipline Inspection and Supervision Office of the Zhenxiong County Commission for Discipline Inspection and Supervision, who handled the Wang Jianwu case, was held criminally responsible for allowing non examination and investigation team member Zhu Shaodong to participate in the investigation, evidence collection, and report modification without organizational approval.
On November 7, 2022, the Zhaoyang District Court of Zhaotong City announced in the first instance that the defendant Zhu Shaodong was guilty of abuse of power, bribery, and bribery. He was sentenced to two years and six months in prison and fined 40000 yuan. The defendant Qin Xiaoling committed the crime of abuse of power and was sentenced to one year and two months in prison. The first instance verdict shows that the prosecution accuses Wang Jianwu of two charges: bribery and dereliction of duty.
Regarding the crime of bribery, it is alleged that from 2019 to 2020, Wang Jianwu took advantage of his position as the deputy director of the Zhenxiong County Public Security Bureau and his influence to repeatedly accept Liang Huaming's property totaling RMB 1.4 million under the pretext of borrowing, in order to seek benefits for others.
Regarding the crime of dereliction of duty, it is alleged that from September 21, 2015 to June 2016, Wang Jianwu, while serving as the captain of the Anti Black Brigade of the Zhenxiong County Public Security Bureau, did not conscientiously fulfill his job responsibilities and did not file a case involving Wu Xuezhong and others. From June 2016 to March 31, 2019, Wang Jianwu, while serving as the Deputy Director of the Zhenxiong County Public Security Bureau and in charge of the work of the Anti Black Brigade, failed to fulfill his relevant responsibilities seriously, resulting in a prolonged delay in the case and multiple complaints from the victims. Later, the court ruled that the case was a criminal gang of evil forces, causing particularly adverse social impact. On June 8, 2017, Wang Jianwu, who was then the deputy director of the Zhenxiong County Public Security Bureau, failed to conscientiously perform his duties in accordance with the relevant regulations during the period when suspect Chenghai, who made the arrest decision to the Zhenxiong County Procuratorate, went on bail pending trial. After being bailed pending trial, Chenghai repeatedly committed illegal and criminal acts, gradually forming a criminal gang of evil forces, which caused particularly bad social impact.
In response to the accusation of bribery, Wang Jianwu argued that he and Liang Minghua have a relative relationship, and that "not brothers are better than brothers". The economic transactions between the two regarding investments, buying houses, and other loans belong to mutual assistance between relatives and did not seek benefits.
Regarding the crime of dereliction of duty, Wang Jianwu argued that the case involving Wu Xuezhong and others was not established. At that time, the director clearly instructed "Deputy Director Yuan Feng to lead the investigation of the Xicheng Police Station under his jurisdiction, and to transfer Zhang Xu, a police officer from the Xihuan Road Stability Maintenance Police Group under his jurisdiction, to participate. The anti gang brigade should not intervene in a timely manner." He presented documentary evidence; Regarding Cheng Hai's release on bail pending trial, he is a fugitive who voluntarily surrendered and enjoys corresponding policies. With the consent of the investigating department and the legal department, the prosecutor's office also has no objection. The process of obtaining bail pending trial is legal, and it is also to adapt to the Yunnan Provincial Public Security Department's "Yunnan Provincial Public Security Department's Anti gang and Anti Evil Fault Correction Mechanism" issued after soliciting opinions and approval from the Provincial Commission for Discipline Inspection and Supervision.
The court found in the first instance that Liang Huaming had sent money to Wang Jianwu multiple times in search of his protection and care, with a total of 1.4 million yuan in property. Among them, Liang Huaming borrowed 500000 yuan from Wang Jianwu for investment, and Wang Jianwu and his wife accounted for a total of 1.5 million yuan in the small mountain canyon tourism project invested and developed by Liang Huaming. The court also found that Wang Jianwu, during his tenure as the captain of the Anti Black Brigade at the Zhenxiong County Public Security Bureau, did not conscientiously fulfill his duties as a member of the Anti Black Brigade. There were already evidence and clues showing characteristics of involvement in multiple criminal acts against Wu Xuezhong and others, but he was not investigated as a criminal case involving black activities, nor was he properly tracked and supervised. In addition, in the Chenghai case, he failed to fulfill his duties seriously in accordance with relevant regulations and was released on bail pending trial. After being released on bail pending trial, Chenghai committed multiple illegal and criminal acts, gradually forming a vicious criminal group, causing particularly adverse social impact.

Disciplinary Inspection Commission investigators abuse their powers and are sentenced in the first instance

During Wang Jianwu's appeal, Qin Xiaoling, former director of the Third Discipline Inspection and Supervision Office of the Zhenxiong County Commission for Discipline Inspection and Supervision, who handled the Wang Jianwu case, was held accountable in accordance with the law for suspected abuse of power.
The first instance judgment of the Zhaoyang District Court shows that Qin Xiaoling was detained by the Weixin County Supervision Committee of Zhaotong City on August 26, 2021, and was criminally detained by the Zhaoyang Branch of the Zhaotong City Public Security Bureau on February 23, 2022. She was arrested on March 4, 2022. Along with Qin Xiaoling, Zhu Shaodong, the former inspector of the Fifth Inspection Group of the Zhenxiong County Committee, was also investigated.
The prosecution accuses that from December 2019 to December 2020, Qin Xiaoling served as the director of the Third Discipline Inspection and Supervision Office of the Zhenxiong County Commission for Discipline Inspection. During the process of handling the case, Qin Xiaoling disclosed the case to Zhu Shaodong, a non examination and investigation team member, without the approval of the leadership, allowing her to access relevant files, revise reports, and participate in questioning the examination and investigation objects. During Qin Xiaoling's handling of the Fu Wei case, Zhu Shaodong interrogated witnesses together and made false witness interview records to alleviate Fu Wei's responsibility. In the case of Zhao Zechun, Liu Xin, and Fan Xiaoguo, where there is evidence to prove that Zhao Zechun should bear party discipline and government responsibility for the consequences caused, Qin Xiaoling proposed disciplinary and written inspection suggestions for her handling. When handling the Wang Jianwu case, Qin Xiaoling asked Zhu Shaodong to investigate and collect evidence from witnesses such as Song Bide, and participate in modifying the report.
After trial, the first instance court found that Zhu Shaodong demanded property from Fu Wei during Qin Xiaoling's handling of the Fu Wei case, and received one piece of Maotai liquor, ten packs of Da Chong Jiu cigarettes, and two pairs of sports shoes. In the case of Qin Xiaoling handling Zhao Zechun, Liu Xin, and Fan Xiaoguo, Zhu Shaodong received a Huawei mobile phone gifted by Zhao Zechun and asked Zhao Zechun to eliminate 39 points of traffic violation penalties for Qin Xiaoling's Audi A7 and pay a violation fine of 2000 yuan. When Qin Xiaoling was handling the Wang Jianwu case, Zhu Shaodong investigated and collected evidence from witnesses such as Song Bide. Song Bide, fearing that her position would be dismissed, gave Zhu Shaodong 20000 yuan in cash.
In 2022, the first instance judgment of the Zhaoyang District Court sentenced the defendant Zhu Shaodong to one year and two months in prison for the crime of abuse of power; Committed the crime of bribery, sentenced to eight months imprisonment and fined 30000 yuan; Committed the crime of bribery, sentenced to eight months imprisonment and fined 10000 yuan. The decision to impose combined punishment for multiple crimes will result in a fixed-term imprisonment of two years and two months, and a fine of 40000 yuan will be imposed. The defendant Qin Xiaoling committed the crime of abuse of power and was sentenced to one year and two months in prison.
Pengpai News learned from Wang Jianwu's defense lawyer that after the retrial of the Wang Jianwu case, a court session was held. However, due to the discovery of illegal evidence, the prosecution suggested an adjournment and postponement of the trial. On August 14, 2023, the Suijiang County Court issued a "Notice of Resumption of Trial", stating that the prosecution has made a recommendation to resume the trial, and the court has decided to resume the trial of the case of Wang Jianwu for bribery and dereliction of duty.
