According to the WeChat official account of the Chinese Embassy in Mongolia, recently, the Chinese Embassy in Mongolia has received reports from Chinese citizens who come to Mongolia to work. Before leaving, domestic recruitment units or labor dispatch agencies did not truthfully inform them of their overseas work, living conditions and salary treatment, did not sign labor contracts, and did not apply for work visas and work and residence certificates for migrant workers in Mongolia according to law. We would like to remind all recruitment units and migrant workers in Mongolia to pay attention to the following points:
1. To work abroad, you should choose qualified companies and be vigilant against the "high salary", "guaranteed salary" and other publicity means or "acquaintances" introduction of some intermediary companies. Please understand and verify the qualification of the labor dispatching company and the actual situation of the employer's salary, working environment and living conditions.
2. The dispatch contract and labor contract must be signed in China, and the labor contract should include major issues such as the place of work, treatment, responsibility for violation of the labor contract, and handling of casualties. Please do not believe the words "sign after arriving in Mongolia". Without a contract, it is difficult to protect the legitimate rights and interests of migrant workers. According to the "Chinese Consular Protection and Assistance" guidelines, consular protection cannot intervene in labor, business, economic, or contract disputes, and cannot interfere with the judicial procedures or law enforcement actions of the country where it is located.
3. Migrant workers must go to Mongolia with a work visa, apply for work and residence certificates in accordance with the law, carry residence certificates with them, and cancel their labor visas before returning home, otherwise they will face a series of problems such as being unable to leave the country normally.
4. Once labor disputes occur overseas, they must be resolved through legal channels and do not take extreme actions. It is recommended to resolve the matter through negotiation first. If the negotiation fails, you can complain to the relevant enterprise's domestic registration place or the person in charge's household registration place, the people's government commerce, public security, industry and commerce administration and the chamber of commerce for foreign labor cooperation, and protect rights in accordance with the law.
5. The parties concerned should fully judge whether they have the professional skills, safety awareness, foreign language proficiency and relevant laws and regulations, religious beliefs, customs and habits.
6. The parties concerned should have a clear understanding of their own abilities, accept the work within their own abilities, and do not believe in the so-called high salary and high welfare, so as to prevent being cheated.
7. Passports are important documents for Chinese citizens to enter and leave the country and prove their nationality and identity abroad. They must be properly kept and photocopied in advance. Do not hand over your passport to others for safekeeping at will, and beware of the other party's seizure of your passport on the grounds of going through relevant procedures. If your passport is detained, you should promptly report the case to the local police and contact the Chinese Embassy.
8. When necessary, the Embassy in Mongolia may provide the contact information of local lawyers and translators at the request of Chinese citizens, and the relevant expenses shall be borne by the citizens themselves.
