The scammers constantly renovate their porcelain collision patterns, making it difficult for some experienced drivers to distinguish between truth and falsehood, resulting in heavy losses. Recently, the People's Procuratorate of Huishan District, Wuxi City, Jiangsu Province, handled a case in which the defendant committed several crimes in this way, defrauding more than 100000 yuan.
In September 2022, Mr. Xu drove a small passenger car from Tianchang, Anhui to Shanghai, and was driving on the Shanghai Chengdu Expressway when he suddenly heard a slight abnormal noise from the car body while changing lanes. Because the car was driving normally, Mr. Xu did not pay attention. Not long after, a silver Mercedes Benz car rushed from behind and drove side by side with Mr. Xu. The Mercedes Benz driver rolled the car window to signal Mr. Xu to stop and approached several times. Mr. Xu had no choice but to follow the Mercedes Benz car into the emergency lane.
Subsequently, three men from Mercedes Benz got off the car and negotiated with Mr. Xu, claiming that the rearview mirror of the vehicle was damaged by Mr. Xu and that the compensation would be several thousand yuan according to the price. If you choose to negotiate the price privately, you can negotiate. Mr. Xu took a closer look and found that there were indeed scratches on his car body. Seeing the large number of people in the other party, Mr. Xu agreed to privately negotiate for 3400 yuan in order to spend money on disaster relief. Upon returning home, Mr. Xu realized that something was going wrong and posted the "private" videos and WeChat transfer records captured on his phone to the online short video platform.
Unexpectedly, a netizen sent a private message to Mr. Xu, claiming that he had encountered a similar accident on the same highway section, which was like a replica of Mr. Xu's experience. After communication between the two, it was discovered that the vehicle involved in the accident and the driver were from the same group, so they called the police. After being investigated by the public security organs, Li and other members of the criminal gang were arrested. In February 2023, the case was transferred to the Huishan District Procuratorate for examination and prosecution.
After investigation, since August 2022, the defendants Li, Zhang, He, and Wang have been driving rented Mercedes Benz and BMW sedans in pairs, damaging the car's mirrors in advance and replacing them with fake license plates. They have been searching for the target vehicle on the Shanghai Nanjing and Shanghai Chengdu expressways and using pre prepared slingshots, olives, and other items to hit the target vehicle. The victim, Mr. Xu, heard the abnormal noise from the car body from this source. After Li and others forced the target vehicle to stop, they took advantage of the victim's lack of attention and used sandpaper to wear and tear the target vehicle, causing a false impression of scratches, and demanded compensation from the other party. The above four defendants have committed nearly 40 consecutive crimes and illegally profited over 60000 yuan.
"In fact, the victim encountered a typical highway porcelain collision scam," said Wang Dong, Director of the First Prosecutor's Department and First level Prosecutor of the Huishan District Procuratorate. The case was committed by a gang and the division of labor was clear; Luxury cars are all rented; Members travel to various places and commit crimes frequently. At the same time, hitting other vehicles with slingshots and olives and overtaking them on the highway can easily cause driver distraction and pose a risk to public safety, and "collision accidents" can easily escalate into traffic accidents.
During the investigation of the case, the procuratorial organs discovered new criminal facts about the gang. Li and four others believed that relying solely on the highway to commit fraud would result in insufficient income of hundreds or even thousands of yuan each time. They then recruited Zhang to join in and together searched for drunk driving vehicles near the restaurant to "hit the porcelain".
On June 11th, the Huishan District Prosecutor's Office filed a public prosecution, and the defendants Li and five others were sentenced by the court to imprisonment ranging from three years to one year and fined between 5000 and 3000 yuan for fraud and extortion.
"There are various ways for vehicles to collide with porcelain, but there are also many similarities." According to Ao Yu, a prosecutor at the Huishan District Prosecutor's Office who has handled an "upgraded" case of drunk driving collision with porcelain, the most obvious feature of such crimes is that the other party will actively raise a private matter, refuse to report to the police for various reasons, and not handle it according to normal procedures. He reminds drivers to strictly abide by traffic regulations, not to take chances, and always remember not to drink or drive. As long as they are strong enough, they are not afraid of any scams.
