On July 24th, netizen "Gongzi Xinya" posted that her shack built in a lychee garden in Shenzhen had been demolished, and the relevant units did not provide an explanation, which immediately attracted public attention.

After the incident escalated, on July 29th, a media report titled "Fruit farmers warning to demolish their own field sheds, street office: policy regulations, grassroots powerless" was released. On July 30th, the Xili Sub district Office of Nanshan District, Shenzhen issued a statement stating that the report was untrue in three aspects: the mention in the report that the staff members of the office were interviewed was untrue; The mention in the report that "fruit farmers were warned to demolish their own sheds in their fields" is not true; The quote in the report that "the street office has policies and regulations, and the grassroots is powerless" is not true.

On the early morning of July 31st, reporters from Shenzhen TV&One Shenzhen client interviewed both sides of the incident overnight to clarify the facts.

According to the person in charge of the Xili Street Office, on the afternoon of May 18th, during an inspection, the staff of the street office discovered that a shed was being built in the Lai Chi Garden located on Likang Road in the Ma Hom community, suspected of illegal construction. Ms. Wang, the person in charge of the lychee orchard, responded at the time that she planned to build a temporary shelter in the lychee orchard for the accommodation of workers during the harvest period. The staff immediately informed her that there must be no illegal activities such as building houses, lighting fires, or damaging the original appearance of the land in the lychee garden. Once discovered, they will be dealt with in accordance with the law.

According to the staff of the street office, considering the lychee harvest period at that time and the demand of fruit farmers for lychee picking, fruit selection, and sales, the staff allowed Ms. Wang to temporarily continue using the shed and explicitly requested her to dismantle it on her own after the lychee harvest was completed. Ms. Wang agreed on-site and verbally promised not to illegally build, not to occupy people, and not to damage the original appearance of the land.

However, during subsequent inspections, the staff noticed that the facility locations discovered earlier had been set up as shelters.

Law enforcement officers presented to reporters an application signed by Ms. Wang on June 14th, requesting support for the temporary construction of lychee orchard sheds. In the application, she promised that no one would live or light a fire in the temporary sheds, and that she would dismantle the temporary sheds within one week after the lychee harvest. If the sheds were not dismantled within the deadline, she would actively cooperate with relevant units to handle them.

According to the staff of the Xili Street Office, in response to the temporary construction of the orchard, the Xili Street Comprehensive Administrative Law Enforcement Team has signed 28 self demolition agreements with multiple fruit farmers, including Ms. Wang. After the lychee picking is completed, multiple sites have fulfilled their commitments to demolish the temporary buildings on time, except for Ms. Wang.

For this reason, law enforcement officers called to request Ms. Wang to demolish the shack as soon as possible, but Ms. Wang stated that she was not in Shenzhen and agreed to have the law enforcement team organize personnel to demolish it in accordance with the law.

What is the purpose of building a shack? Is there any violation of residential regulations during this period? From the on-site videos and photos displayed by law enforcement personnel, it can be seen that there are indeed upper and lower beds, mosquito nets, pillows, and mats placed in the temporary structures in the lychee garden, with obvious signs of residential life.

Ms. Wang admitted that there were indeed temporary residents in the sheds because a large number of people were needed during the lychee harvest period, and it was difficult to properly solve the accommodation problem for the workers.

According to the reporter's understanding, most fruit farmers pick fruits in the morning and sell them during the day. There is no need for picking workers to live in the orchard, but Ms. Wang sells them all day through online live streaming, so she keeps workers picking fruits in the orchard at any time.

Why not allow people to build shacks in the orchard? The statement from the Xili Street Office is that there are frequent typhoons and intense thunderstorms in Shenzhen during the summer, and there are significant safety hazards for residents living in fruit groves.

According to Zhang Fahua, Deputy Leader of the Comprehensive Administrative Law Enforcement Team of Xili Street, the lychee orchard belongs to the blue line management scope of Yangtai Mountain Forest Park and is a type of agricultural land. The current temporary construction violates Article 44 of the Urban and Rural Planning Law of the People's Republic of China: "If temporary construction is carried out within the urban or town planning area, it must be approved by the urban and rural planning department of the city or county people's government. If temporary construction affects the implementation of recent construction plans or detailed control plans, as well as traffic, urban appearance, safety, etc., it cannot be approved. Temporary construction should be demolished on its own within the approved use period. The specific measures for temporary construction and temporary land planning management shall be formulated by the people's governments of provinces, autonomous regions, and municipalities directly under the central government."

The basis for this punishment is as mentioned in Article 66, which states: "If a construction unit or individual commits any of the following acts, the urban and rural planning department of the local city or county people's government shall order the demolition within a specified period of time, and may also impose a fine of not more than twice the cost of the temporary construction project: if temporary construction is carried out without approval; if temporary construction is not carried out according to the approved content; if temporary buildings or structures are not demolished beyond the approved period."

Zhang Fahua said, "Regarding the situation where new and old sheds were demolished, after our verification, because she was connected to the old shed when building the new shed, there were supervision personnel living inside, and there was a situation of starting a fire and cooking, which posed a significant safety hazard. Therefore, we demolished the location where the new and old sheds were connected together, and there were still enough temporary agricultural buildings left on site. We did not demolish this part."

Ms. Wang told reporters that although there were differences in communication between the two sides, the Nanshan District government, including law enforcement personnel, had proposed to help fruit farmers expand their sales channels by organizing various activities, which made her feel the goodwill and concern of the government departments.

Ms. Wang recalled that the communication between the two sides during the law enforcement process was generally peaceful, and personally, she did not want the situation to continue to escalate. "I personally believe that Shenzhen's law enforcement tends to be more humane, and there was no excessive behavior at that time. Shenzhen is a very civilized city and also a city that I really like. I really hope this matter can be calmed down."
