In September and November 2022, the Ministry of Natural Resources publicly supervised four cases of land violations. On August 29, 2023, in accordance with the Measures for the Supervision and Public Notification of Illegal and Non compliant Cases by the Ministry of Natural Resources, the Ministry of Natural Resources announced the investigation and handling results of four cases.


1、 The problem of illegal occupation of land and construction of golf courses by Longde Real Estate Development Co., Ltd. in Datong City, Shanxi Province



The golf course project of Datong Longde Real Estate Development Co., Ltd., also known as Shanxi Datong Tulin Ecological Tourism Sightseeing Park, is located in Xingsheng Village and Jianpu Village, Dangliuzhuang Township, Yunzhou District, Datong City. Construction began in August 2012 and by November 2014, the underground facilities of the West and East stadiums were completed, covering a total area of 954.51 acres, including 81 acres of arable land, 1.85 acres of rural roads, and 871.66 acres of unused land. The stadium has not been put into operation. After the merger and acquisition of Datong Longde Real Estate Development Co., Ltd. in January 2017, the Yunqi Agricultural and Health Tourism Ecological Leisure Sports Project was constructed on the original stadium site. The golf course has not been investigated and rectified in accordance with relevant requirements until the investigation in July 2022, when the characteristics of the golf course were not completely eliminated. At present, the involved stadium has been banned.

The Datong Municipal Government and enterprises have drafted a cooperation framework agreement and inspected the introduction of projects. The executive meeting and special meeting of the Municipal Government have decided that the original Datong County Government will implement and promote the preliminary construction of the project, but there are problems with lax supervision and inadequate supervision. From August 2010 to November 2014, the former Datong County Party Committee and County Government included golf course projects in the construction of ecological sports parks through land transfer through special meetings of the County Party and Government, executive meetings of the County Government, county mayor's office meetings, and special meetings. Although they studied and abolished the provisions related to golf courses and signed a new supplementary agreement, they did not stop the relevant construction in a timely manner, resulting in the fact that golf courses illegally occupied land and constituting illegal approval of land use. In addition, there are problems such as inadequate cleaning and rectification of golf courses in Yunzhou District, and illegal occupation of land by Datong Longde Real Estate Development Co., Ltd.

After the investigation organized by the Department of Natural Resources of Shanxi Province, the handling opinions were clarified: it was confirmed that the minutes and documents of the relevant meetings of the Datong Municipal Government and the former Datong County Party Committee and County Government regarding the golf course were invalid, and it was confirmed that the agreements and supplementary agreements signed between the former Datong County Government and enterprises regarding the use of transferred land for non-agricultural construction were invalid. Datong Longde Real Estate Development Co., Ltd. should use the transferred land in accordance with the law and regulations. Order the government of Yunzhou District to govern the illegally occupied farmland of the golf course project and restore the cultivation conditions, return it to the collective economic organization, and ensure the use of agricultural land. Dispose of illegal buildings in accordance with the law and regulations. According to the management authority of cadres, the problem clues shall be transferred to the disciplinary inspection and supervision organs for accountability in accordance with the law and regulations.


2、 The problem of illegal land use and ecological restoration project construction by the Landscape and Environmental Health Administration of Haikou City, Hainan Province



The first phase of the water system ecological restoration project in the southern area of the West Coast New Area of Haikou City is located in Changliu Town and Xixiu Town, Xiuying District, Haikou City. The construction unit is the Haikou City Landscape and Environmental Health Management Bureau, and the construction content includes connecting and expanding the river channel according to the flood control and drainage plan, terrain consolidation, and greening on both banks. Construction started in July 2019 and stopped in October 2021, covering a total area of 1099.34 acres, including 291.23 acres of arable land, 417.24 acres of forest land, 25.23 acres of other agricultural land, 315.88 acres of construction land, and 49.76 acres of unused land. It was used for excavating 278.35 acres of river channels and planting trees and grass on both sides of 820.99 acres. At present, 857.50 acres of agricultural land have been converted and land acquisition procedures have been completed, 200.92 acres of land have not yet completed agricultural land conversion and land acquisition procedures, and 40.92 acres of state-owned construction land have not been provided with land supply procedures.

From December 2010 to July 2019, without completing the land use procedures in accordance with the law, the Haikou Municipal Government decided to implement land acquisition by the Xiuying District Government through holding a special meeting, determining the start time, and supervising the start of construction. The Haikou Landscape and Environmental Health Administration organized construction, which constituted illegal approval of land acquisition and use. During the project construction process, relevant departments and units did not fulfill their regulatory responsibilities properly.

After organizing an investigation, the Hainan Provincial Department of Natural Resources and Planning has clarified its handling opinions: it has been confirmed that the relevant content of the Haikou Municipal Government's special meetings and documents related to illegal approval of land acquisition and use is invalid. The use of land shall be disposed of in accordance with laws, regulations, and procedures in accordance with the law. For land that has not yet obtained land use procedures, after the illegal issues are resolved, the land use procedures shall be improved in accordance with the national spatial planning in accordance with the law. 3、 The problem of Global Century Exhibition and Tourism Group Co., Ltd. illegally using land to construct the Global Rongchuang Future City project in Renshou County, Meishan City, Sichuan Province

The Global Rongchuang Future City project, also known as the LEGO Park project, is located in Shigao Street, Renshou County. It is invested and constructed by Zhongjun Tianxin Culture Co., Ltd. and Global Century Exhibition Tourism Group Co., Ltd. The project started construction in June 2020 and covers a total area of 5067 acres until October 2021. Among them, 3660 acres of agricultural land conversion, land acquisition, and land supply procedures were completed before the start of construction; 550 acres of agricultural land have been converted and expropriated but not supplied for the construction of sales offices, parking lots, etc; 857 acres of land have started construction without completing the procedures for agricultural land conversion and land acquisition. Currently, 646 acres have completed the procedures, and there are still 211 acres that have not completed the land use procedures for building green landscapes, amusement facilities, roads, etc.

From June 2018 to April 2021, the Renshou County Party Committee and County Government, without handling land use procedures in accordance with laws and regulations, organized and promoted the implementation of land acquisition, compensation, and project construction through the establishment of a leading group for promoting work, a project promotion command center, and the convening of the County Party Committee Standing Committee, County Government Executive Meeting, and other relevant meetings, which constituted illegal approval of land acquisition and use. Relevant units and departments have problems such as illegal and irregular implementation of land acquisition compensation, promotion of project and partial supporting facility construction, and inadequate supervision and inspection.

After the investigation organized by the Sichuan Provincial Department of Natural Resources, the handling opinion was clarified: it was confirmed that the content related to illegal approval of land acquisition and use in the relevant meetings of the Renshou County Party Committee, County Government, and Project Promotion Command was invalid. Retrieve illegally approved land for expropriation and use in accordance with the law; For land that has not yet completed land use procedures, it shall be ordered to restore the original state of the land and return it to the collective economic organization. After the illegal issues are resolved, the land use and construction procedures for the already built above ground buildings shall be improved in accordance with the law and regulations. Instruct the Renshou County Party Committee and County Government to conduct a thorough inspection of the Meishan Municipal Party Committee and Government.


4、 Illegal Land Use in the "Tianyingzhai" Ginkgo Landscape Forest Demonstration Park in Dachuan District, Dazhou City, Sichuan Province



The Tianyingzhai Ginkgo Landscape Forest Demonstration Park project is located in Wanjia Town, Dachuan District, Dazhou City, including Ginkgo Plantation Park, Ginkgo Avenue, Baidao Flower Lake, Commercial Street, Reception Center, Tianyingzhai Homestay, etc. The construction unit of Ginkgo Avenue is Dazhou Daoda Transportation Development Co., Ltd., while the rest is mainly invested and constructed by Sichuan Youteng Agricultural Technology Co., Ltd. The project was constructed from February 2017 to December 2021, covering a total area of 16700 acres, including 14800 acres of ginkgo forest; 574.28 acres of non-agricultural construction, of which 557.21 acres have not completed land use procedures; The original use of 1347.62 acres has not been changed.

The Dachuan District Committee and Government, through signing investment agreements and holding standing meetings of the district committee and government, arrange relevant units and departments, as well as development enterprises, to implement land acquisition compensation and promote project construction under the name of land transfer, which constitutes illegal approval of land acquisition and use. In addition, there are issues such as illegal and irregular preparation and approval of urban and rural planning, illegal return of land transfer fees, and failure of relevant units and departments to fulfill their supervisory and inspection responsibilities in accordance with the law and regulations.

After the investigation organized by the Sichuan Provincial Department of Natural Resources, it was confirmed that the content related to illegal approval of land acquisition, use, and illegal return of land transfer fees in the relevant meetings of the Dachuan District Committee and Government was invalid. The land was lawfully recovered and returned to the collective economic organization, and the Dachuan District Government corrected the issue of illegal return of land transfer fees. After the illegal issues are dealt with in accordance with the law and regulations, corrective measures such as improving relevant procedures, restoring farmland cultivation, or forestry cultivation will be taken separately; Planting ginkgo trees on farmland should be handled prudently and prudently, and orderly withdrawal or rectification should be carried out.
