In the re organized tomb raiding activity of 8 people, a large amount of carbon monoxide gas was generated inside the cave due to gasoline pumping equipment, resulting in the poisoning and death of 3 people who were excavated inside the cave. Due to the deaths of three people, this matter was exposed, and Qian and five others voluntarily surrendered to the public security organs. At present, the court has sentenced six defendants to imprisonment ranging from ten months to one year and eight months, and imposed corresponding fines.
Infighting
On the eve of the Dragon Boat Festival in 2022, Mr. Chen gathered Mr. Lang, Mr. Qian and other five people, took shovel, pickaxe and other tools, and drove a motor vehicle to the mountain near Aohan Banner to steal ancient tombs. However, it rained heavily, and several people stopped working after two days of digging. Chen and his group were unwilling, and a few days later, Chen gathered manpower again. This time, the tomb raiding gang expanded to seven people and went to the mountain to continue excavation. Because there are too many people and there are not enough tomb robbing tools, several people negotiate to buy digging tools such as ropes, shovel and pickaxes. So the question is, who will contribute to the purchase? A few people each carried a ghost and refused to contribute, causing internal strife through pushing and shoving, and thus they dispersed.
Poisoned to death
After more than a month, Chen was still unwilling to accept it. He worked tirelessly and became so rampant that he gathered 8 people to form a gang. This time, it can be said that the organization was meticulous. In the hope of achieving results in tomb raiding, two cars were driven separately. During the day, work was stopped, and in the dark, excavation was carried out. One person was transporting and delivering food on the periphery, four people were lifting and unloading soil at the entrance of the cave, and three people took turns digging at the bottom of the cave. I saw the cave digging deeper and deeper, and rainwater flowed into the cave, making it impossible to continue digging. I also bought gasoline pumping equipment to drain the accumulated water from the cave outward. This time, the matter became serious. The gasoline pumping equipment generated a large amount of carbon monoxide gas in the cave, causing poisoning and death of three people who were excavated inside the cave. Due to the deaths of three people, this matter was exposed, and Qian and five others voluntarily surrendered to the public security organs, thus ending the tomb robbery.
The People's Court of Aohan Banner believes that the defendant Qian and six others, together with others, violated the national cultural relics management system by secretly excavating ancient tombs with historical and scientific value. Their behavior has constituted the crime of robbing ancient tombs and is a joint crime. The court makes a judgment in accordance with Article 328 of the Criminal Law of the People's Republic of China and relevant legal provisions. Six people appealed against the first instance verdict, but the second instance rejected the appeal and upheld the original verdict.
