They were sentenced to imprisonment ranging from ten months to one year and eight months, and corresponding fines.
On the eve of the Dragon Boat Festival in 2022, Mr. Chen gathered Mr. Lang, Mr. Qian and other five people, took shovel, pickaxe and other tools, and drove a motor vehicle to the mountain near Aohan Banner to steal ancient tombs. Due to heavy rain, several people stopped digging two days later. Chen and his group were unwilling, and a few days later, Chen gathered manpower again. This time, the tomb raiding gang expanded to seven people and went to the mountain to continue excavation. Because there are too many people and there are not enough tomb robbing tools, several people negotiate to buy digging tools such as ropes, shovel and pickaxes. Due to internal conflicts caused by issues such as who will provide the funds for purchasing tools and who will purchase them, they eventually parted ways unhappily.
A month later, Chen was unwilling and gathered 8 people to form a tomb raiding gang again. The gang has a clear division of labor this time, driving two cars separately, stopping work during the day and digging holes at night. One person transports and delivers food on the periphery, four people lift and unload soil at the entrance, and three people take turns digging at the bottom of the cave. The cave dug deeper and deeper, but due to the rain during the excavation process, the rainwater flowed into the cave and could not continue to be excavated. The group also purchased gasoline pumping equipment to discharge the accumulated water from the cave outward. Due to the large amount of carbon monoxide gas generated by the gasoline pumping equipment in the cave, three people who were excavated inside were poisoned and killed. Due to the deaths of three people and the revelation of tomb robbery, Qian and five others voluntarily surrendered to the public security organs.
The court believes that the defendant Qian and six others, together with others, violated the national cultural relics management system by secretly excavating ancient tombs with historical and scientific value. Their behavior has constituted the crime of robbing ancient tombs and is a joint crime. The court makes a judgment in accordance with Article 328 of the Criminal Law of the People's Republic of China and relevant legal provisions. Six people appealed against the first instance verdict, but the second instance rejected the appeal and upheld the original verdict.
