Starting from January 2021, China prohibits the import of solid waste in any form, and also prohibits the entry, dumping, stacking, or disposal of solid waste from abroad. However, there is still a constant stream of foreign waste, taking risks and attempting to "sell" or "send" it to China. In the first five months of this year, Shanghai Customs cleared and returned 57 shipments of foreign garbage, totaling nearly 900 tons.
Once foreign waste enters the country, its return and disposal involve multiple processes, including on-site inspection, sampling and inspection, solid waste identification, result notification, transfer of anti smuggling, and order for return, involving management departments such as ecological environment, greening and urban management, and anti smuggling office. In the face of the unwavering task of safeguarding the green mountains and clear waters, Shanghai Customs has established a consultation mechanism with multiple departments, and collaborated with port and shipping units such as Shanghai Port Group and Maersk to follow the principles of "quick identification, quick identification, quick movement, and quick return". At the same time, it has provided incentive measures such as cost reduction for actively cooperating and returning enterprises, ensuring that a batch is discovered and disposed of in the shortest possible time.
At present, many imported foreign garbage often goes unclaimed. It may be because the consignee feels that the risk is high and is afraid to declare customs or choose to abandon the goods, or it may be because overseas unscrupulous merchants have deliberately forged a domestic consignee with the aim of transporting foreign garbage out. To this end, Shanghai Customs has interviewed the shipping companies involved in the disposal of foreign waste one by one, encouraging them to actively contact overseas shippers, open up return routes, and establish a contact group for solid waste clearance and disposal, providing all-weather response and all possible support measures for solid waste return. Shanghai Outer Port once concentrated the disposal of 88 parcels of 4902 tons of unclaimed foreign garbage that had been stranded at the port.
Seeking legal breakthroughs is another way to combat foreign waste. In the past, whether the shipowner involved in the case returned the smuggled imported solid waste after it was seized would not affect the final judgment. Shanghai Customs is exploring the use of "actively completing the return of goods" as a discretionary circumstance for mitigating or mitigating punishment, and has communicated and discussed with the court multiple times. In the trial of a smuggling of solid waste case in September 2021, the judge did not directly pronounce a verdict, but informed the shipowner involved that they should return the solid waste within a certain period of time before deciding on sentencing. The involved shipper actively promoted the return of the shipment and ultimately received a reduced sentence.
Of course, mastering the trend of foreign waste in advance and turning passivity into initiative is the most powerful means. The Shanghai Customs Port Supervision Office introduced that the ongoing construction of a smart customs will automatically integrate multiple data and work records, continuously empowering and increasing efficiency for the supervision and disposal of foreign waste. Previously, after exchanging information with customs departments of various countries, 13 suspected solid waste containers intended to be sent to Shanghai from the UK were forced to return midway or arrive in Shanghai under heavy pressure before leaving Shanghai again.
