The "Pure Edition" parking payment QR code does not collect any personal information. The Shanghai shopping mall has comprehensively rectified the issue | Consumers | Shanghai
Taking advantage of consumers' urgent psychology to pay the parking fee as soon as possible and leave the site, many shopping malls and buildings have become obsessed with creating obstacles before consumers enter the direct payment page, inducing or even forcing consumers to pay attention to personal information such as official account, registered members, names, mobile phone numbers, WeChat or Alipay accounts.
Under the guidance of the Network Law Enforcement and Supervision Bureau of the State Cyberspace Administration, Shanghai is carrying out the "Bright Sword Pujiang" special law enforcement action to protect personal information rights and interests in the consumption field, vigorously cracking down on illegal behaviors that infringe on consumer personal information rights and interests in areas such as catering and parking payment.
Jiefang Daily's Shangguan News reporter learned today from the Shanghai Cyberspace Administration and the Shanghai Market Supervision Bureau that after inspection, interviews, and supervision, Bailian Group will use the "pure version" parking payment QR code in the parking lots of 18 shopping malls, including the First Department Store Commercial Center and Bailian Youyi City. The Heshenghui located in the Wujiaochang commercial district has also activated the "pure version" parking payment QR code.
On July 27th, the underground parking garage of Bailian Youyi City, located in the Wujiaochang commercial district, has been renovated. A brand new "pure version" parking payment QR code has been posted in prominent positions on the walls of the entire garage, inside the mall elevator, and at the exit of the B2 floor elevator, with the words "scan the code directly, pay to leave" printed above the QR code.
According to the tips on the poster, scan the QR code and directly jump to the parking payment page, without paying attention to the mall's official account, registered members and checking the informed consent box, just input the license plate number and click Pay, which will take several seconds to more than ten seconds to complete the payment.
Previously, in response to the issue of excessive collection of personal information for parking fees, law enforcement officers from the Shanghai Cyberspace Administration and the Municipal Market Supervision Bureau conducted an on-site inspection of relevant commercial districts in Yangpu District on July 21.
The inspection found that there were problems in Youyicheng parking lot, such as inducing users to register members, paying attention to the official account, and forcing consumers to agree to the privacy policy of third-party enterprises with the member registration and login function; The Heshenghui parking lot has problems in inducing users to pay attention to the official account and forcing consumers to register members.

Law enforcement officers should point out problems to the responsible persons of two shopping malls and demand rectification, and carry out on-site legal education. In the afternoon of that day, the Shanghai Municipal Cyberspace Administration and the Municipal Market Supervision Bureau, together with the Municipal State owned Assets Supervision and Administration Commission, the Municipal Commission of Commerce, and the Yangpu Cyberspace Administration, held talks with two enterprises, requesting that Youyi City and Heshenghui comprehensively rectify the excessive collection of personal information in the parking payment process, take necessary measures to ensure that the activities of processing consumer personal information comply with laws and administrative regulations, and effectively prevent the risk of information leakage.
The heads of two companies stated that due to inadequate understanding of legal provisions such as the Personal Information Protection Law and the Methods for Determining the Illegal Collection and Use of Personal Information by APPs, problems have arisen. They will actively cooperate with regulatory authorities in accordance with the interview requirements, conduct self inspection and rectification, and implement the "pure version" parking payment QR code work requirements as soon as possible.
Liu Lei, the relevant person in charge of Bailian Group, stated that on July 24th, Bailian Group urgently deployed new materials to replace the original parking and payment QR codes, and issued them to its shopping malls, which were posted in prominent locations in the basement, elevator halls, VIP rooms, and customer service centers. The use of the "pure version" parking payment QR code in this parking lot involves 15 shopping malls of Bailian Group in Shanghai and 3 shopping malls in other provinces and cities.
On July 21st, the Shanghai Consumer Protection Commission also released a survey result. After conducting undercover investigations on 140 shopping malls in 29 city level commercial centers and 45 regional level commercial centers, it was found that 27 shopping malls, including Aegean Sea Shopping Park, Sun and Moon Center, BFC Bund Financial Center, and Bailian Youyi City, forced consumers to add members or demand personal information during the process of scanning and paying parking fees. The Shanghai Consumer Protection Commission has handed over the clues to the Shanghai Cyberspace Administration and the Shanghai Market Supervision Bureau for inclusion in the ongoing "Bright Sword Pujiang" campaign.
The relevant person in charge of the Shanghai Cyberspace Administration pointed out that when shopping malls provide parking services, consumers have the obligation to pay the parking fees according to the agreement. Operators of shopping malls or parking lots force or induce consumers to join shopping mall members or pay attention to official account before paying parking fees, which is excessive collection of consumer personal information and violates the relevant provisions of the Personal Information Protection Law.
The Shanghai Cyberspace Administration, the Municipal Market Supervision Bureau, and the Municipal Consumer Protection Commission have stated that operators of shopping malls or parking lots should promptly release a "pure version" parking payment QR code and prominently mark relevant words such as "scan the code directly, pay to leave" to ensure that no personal information is collected. If the store membership code or official account QR code is posted in the name of parking fee discount, member points, etc., there must be sufficient prompts and only personal information related to relevant services must be collected to effectively protect consumers' right to know, right to choose, and legitimate rights and interests of personal information. If the mall posts the QR code of member or official account in the name of parking fee discount, it must also post the QR code of "directly scanning the code to pay parking fee".
