Recently, according to reports from netizens and inspections by regulatory authorities, some children's training institutions in Shanghai have engaged in illegal and irregular behavior of excessive, compulsory, and induced collection of non essential personal information of minors when providing services.
Jiefang Daily's Shangguan News reporter learned today from the Shanghai Cyberspace Administration and the Shanghai Market Supervision Bureau that regulatory authorities have lawfully interviewed multiple off campus training institutions, requiring the operating entities to comprehensively rectify, formulate and improve internal management systems to strengthen personal information protection, and effectively fulfill their personal information protection obligations. The Shanghai Cyberspace Administration has filed a case and punished a children's foreign language training enterprise with serious violations.
Under the guidance of the competent authorities, five children's training chain institutions, including Qinhan Hutong, Dongfang Children's Painting, Stan Planet, Xiaoying Star, and Angli Education, have made self-discipline commitments to protect consumer personal information rights, involving their 206 stores in Shanghai.
These institutions promise to "collect the smallest amount, manage the strictest, and handle the fastest", and release several measures to ensure the personal information security of underage students to the public through various forms such as online publishing, offline announcements, and store promotion. For example, five training institutions will only collect four personal information items, including student name, date of birth, parent name, and contact information, based on the principle of minimum and necessity when the parents clearly register for the course, for specific training services such as student management.
The above-mentioned training institutions also stated that they will take corresponding technologies and necessary measures to prevent risks such as personal information leakage and abuse, and provide convenient reporting channels to accept parental supervision and provide feedback on the disposal results.
It is also reported that during the recent enrollment season, according to reported clues, some off campus training institutions have obtained information about some students through improper means and carried out precision marketing activities such as course recommendations.
The Shanghai Cyberspace Administration has clearly pointed out that all types of schools and training institutions, as personal information processors, should strictly implement the relevant requirements of the Personal Information Protection Law, strengthen internal training and confidentiality education for key positions, adopt security technology measures such as encryption and de identification to strengthen student personal information management and prevent information leakage. The Shanghai Cyberspace Administration will work with market supervision and other departments to thoroughly investigate and hold accountable illegal and irregular clues, and handle them in accordance with the law.
