After investigation, it was found that the Traditional Chinese Medicine Technology Cooperation Center of the Chinese Academy of Traditional Chinese Medicine does not have a subsidiary institution named "Shanghai Academy of Traditional Chinese Medicine Ointment Formula Research", nor has it ever granted the qualification of "joining a cooperative health care institution" to the parties involved, nor has it ever had any form of cooperation with the parties involved. The party involved engaged in unauthorized external business under the name of the franchisee of Shanghai Traditional Chinese Medicine Cream Research Institute of the Chinese Academy of Traditional Chinese Medicine Technology Cooperation Center, which is enough to lead people to mistakenly believe that there is a specific connection between the party and the above-mentioned institution.
In addition, it was found that the parties concerned had printed the words "Products Specially Recommended by the Chinese Expert Meeting on the Prevention and Control of Infectious Diseases" on the shell of the health care instrument they sold, and had printed the words "Anti influenza, Keep Away from COVID-19", "Antibacterial disinfection", "Eliminating odor and formaldehyde", "Aromatic hypnosis" and other words on the packaging box of the purifier. It is verified that the purifier does not have the functions of anti influenza, keeping away from COVID-19, bacteriostasis and disinfection, formaldehyde removal, etc.
The commercial confusion and false commercial propaganda of the parties involved violated the relevant provisions of the Anti Unfair Competition Law, and the Hongkou District Market Supervision Bureau imposed an administrative penalty of 240000 yuan on them.
Shanghai Taikang Baibo Xianger Dental Clinic Co., Ltd. has been reported for publishing false advertisements. After investigation, the parties involved posted dental implant advertisements through a certain APP, which included content such as "subsidy ratio as high as 44%, designated public welfare dental implants, assistance from Lingtaikang Baibo Love Fund, maximum reimbursement of 8500 yuan per dental implant, and limited time subsidies.".
However, the so-called subsidy ratio, love fund assistance, and other content are all untrue and belong to false advertising. On April 21, 2023, the Market Supervision Bureau of Yangpu District imposed an administrative penalty of 40000 yuan on the parties involved.
In addition to accompanying famous brands, celebrities, and hitchhikers, some illegal operators also hire "water soldiers" to ask and answer questions, and fabricate word-of-mouth.
Shanghai Yimian Food Technology Co., Ltd. has signed a "Rhino Cloud Software and Personalized Service Purchase Contract" with Company A. Company A will use a self operated account registered on the Q&A platform to post questions related to the products of the parties involved, and use other self operated accounts to answer the above "questions" that are conducive to the positive promotion of the products of the parties involved. In this way, Company A will impersonate real users to post false subjective experiences, judgments, and other content about the products of the parties involved, helping them improve the positive reputation of the products.
According to statistics, Company A has written a total of 160 Q&A questions for the parties involved. The behavior of the parties involved violates the relevant provisions of the Anti Unfair Competition Law. The Minhang District Market Supervision Bureau imposed an administrative penalty of ordering the parties to cease their illegal activities and imposing a fine of 200000 yuan.
Today, the Shanghai market regulatory authorities also exposed a problematic youth league case.
The production process of Youth League has high requirements for environmental hygiene. Some illegal enterprises do not focus on improving production processes and product quality, but engage in food production and operation by lowering hygiene standards, using preservatives beyond the scope, and illegally adding substances that may harm human health, disregarding the health of the people.
In March 2023, the Market Supervision Bureau of Songjiang District conducted a special inspection on Youth League and Food Additives. Law enforcement personnel reviewed the monitoring of the park and found that since February 2023, Shanghai Hejianyuan Food Co., Ltd., which falsely claimed that the company was in a state of shutdown, has been engaged in Youth League production activities almost every day.
After verification, the parties involved had a total of 8 batches of 847 boxes of unqualified products, with issues such as excessive use of preservatives and microbial contamination. The value of the goods exceeded 180000 yuan.
On June 13, 2023, the Market Supervision Bureau of Songjiang District investigated and dealt with the illegal behavior of the parties involved in producing food that does not meet food safety standards. Due to the obvious subjective intention and high value of the goods in the illegal behavior of the parties involved, which is suspected of constituting a crime, the Songjiang District Market Supervision Bureau has lawfully transferred the case to the public security organs.
