Recently, several "nostalgic snack shops" in popular commercial districts in the center of Shanghai, such as Nanjing East Road and Tianzifang, have been exposed by netizens for selling products with packaging containing "vulgar" content. Jiefang Daily's Shangguan News reporter learned today from the Huangpu District Market Supervision Bureau that relevant operators have been investigated for suspected violations of relevant regulations such as the Advertising Law.
The Market Supervision Bureau of Huangpu District stated that on the evening of August 13th, law enforcement officers inspected the "Nostalgic Snacks Shop" and "Childhood Snacks Shop" on Nanjing East Road. On site, they found that nearly 20 products being sold by the "Nostalgic Snacks Shop" were printed with contents such as "sow feed", "cheap men's loss reducing tablets", "pleasure seeking stimulants", "academic achievers catalysts", and "eating non fat pills" on the outer packaging. The two parties mentioned above are suspected of violating relevant provisions of the Advertising Law, and the Huangpu District Market Supervision Bureau has initiated an investigation.
Some netizens are confused about whether the outer packaging of the product is an advertisement and whether it contains "vulgar" content that violates the Advertising Law.
In response to this, legal professionals have stated that according to the relevant guidance of the State Administration for Market Regulation on advertising supervision and law enforcement work, product packaging materials themselves can serve as the medium for publishing advertising content. Enterprises can print advertising content on the outer packaging of products, directly or indirectly introducing their own products or services. This part of advertising content should comply with the relevant provisions of the Advertising Law. For example, advertisements must not interfere with social public order or violate good social customs, and must not harm the physical and mental health of minors. That is to say, products with "vulgar" content on the outer packaging are also suspected of violating the Advertising Law.
It is worth noting that the two operators mentioned above are not first-time offenders and have a record of dishonesty before selling "vulgar" products.
The reporter found on the National Enterprise Credit Information Publicity Platform that the "Nostalgia Snack Shop" on Nanjing East Road was subject to an administrative penalty decision by the Huangpu District Market Supervision Bureau on March 30 this year, which confiscated infringing goods, ordered immediate cessation of infringement, fined 1000 yuan, and issued a warning.
After investigation, from February 6th to 10th, 2023, the parties involved sold badges with the Olympic Five Rings pattern in the store without the permission of the Olympic logo owner. The above badge was obtained from someone else's doorstep promotion in February 2023, and the parties involved are unable to provide proof of purchase.
According to the National Enterprise Credit Information Publicity Platform, there are two individual industrial and commercial households registered at No. 18, Lane 274, Taikang Road, both of which were included in the list of abnormal business operations due to failure to submit annual report information in accordance with regulations. Qiaotuo Crafts Store in Huangpu District, Shanghai was listed on the list of abnormal business operations for five consecutive times from July 2015 to July 2021.
