What should we do if we lose contact?, Can fishermen who have been sentenced to probation for crimes go out to sea? It's time for correction during the fishing season | Target | Fisherman
Not long ago, fisherman Qi was sentenced to one year imprisonment with a one-year probation by the court for committing a crime. If he cannot go out to sea to work during the fishing season, he will lose his main economic income. However, if he is undergoing community correction and goes out to sea, will he lose contact with him? Faced with this dilemma, the People's Procuratorate of Pudong New Area in Shanghai took the initiative to help fishermen solve their problems.
"The correctional targets of communities related to sea and fishing are a relatively special type of correctional targets, and going out to sea work is their main source of economic income. With the end of the fishing ban, being allowed to go out to sea for fishing is their most urgent need, and it is also the key to their reintegration into society." The prosecutor introduced that in order to solve the problems faced by correctional targets of communities related to sea and fishing, such as "difficult to go out to sea for leave, difficult to supervise supervision, and difficult to provide education and assistance", the Supreme People's Procuratorate, in conjunction with the Ministry of Justice, has deployed procuratorial organs and community correctional institutions in 11 coastal provinces across the country to carry out regulatory and legal supervision work for correctional targets related to sea and fishing in accordance with the law, effectively solving the pain points and difficulties of correctional targets related to sea and fishing. ".
According to the work deployment, the Pudong Procuratorate has conducted investigation and investigation on the situation of correctional targets related to sea and fishing in its jurisdiction in recent years, and has visited relevant departments multiple times to jointly discuss supervision and management measures. In July of this year, the Pudong New Area Procuratorate, together with the Pudong New Area Judicial Bureau and the Pudong New Area Agriculture and Rural Committee, jointly formulated the "Shanghai Pudong New Area Maritime and Fishery Community Correction Objects Going Out Activities Supervision and Management Measures", which provided detailed regulations on the application, approval, management, and prosecutorial supervision of commercial going out activities for maritime and fishery correction objects.
Not long ago, three units held a hearing on the issue of the corrective object Qi, who frequently goes out for fishing related to the sea, and his request for leave for frequent fishing trips was publicly heard. Prosecutors, community correction workers, fishery management personnel, and people's supervisors jointly participate in listening to the application reasons and opinions of community correction objects.
At the meeting, representatives from all parties publicly questioned and reviewed the necessity, feasibility, and supervision of the correctional subject's frequent outings during their absence. Prosecutors and people's supervisors have made suggestions for regulating supervision through hearings, and at the same time believe that for correctional subjects who, due to normal work and life needs, apply for frequent outings and must cross cities and counties for sea operations, under effective implementation of maritime supervision measures, community correctional institutions will approve their applications, which will help solve the actual difficulties of correctional subjects and help them better return to society.
However, during fishing operations at sea, fishermen often experience poor or even no network signal. How can we ensure that the correctional subjects do not lose contact as a result?
The Measures stipulate that the fishery management department of the Agriculture and Rural Affairs Commission should provide assistance and supervision during maritime operations, and use regulatory methods such as Beidou positioning and satellite telephone to provide community correction institutions with real-time dynamic trajectories of employment vessels sailing at sea, ensuring standardized law enforcement efforts.
In addition, the prosecutor also suggests that community correction institutions and judicial institutions should do a good job of telephone supervision, allowing community correction objects to report their location daily through WeChat, SMS, or satellite phone calls, and actively report their outdoor activities. At the same time, it is recommended that the captain of the fishing vessel where the correction object is located serve as the guarantor for daily supervision, management, and educational assistance.
Next, the Pudong Procuratorate will guide community correctional institutions to explore the establishment of a dynamic management mechanism for frequent leave requests from correctional objects involved in maritime and fishing activities. The linkage and performance of duties will be integrated into the entire process of matter approval, outbound supervision, and leave cancellation management, effectively safeguarding the legitimate rights and interests of correctional objects involved in maritime and fishing activities.
