The 3J cherries in the live broadcast room cost only 199 yuan for 6 pounds? After placing an order, a consumer in Shanghai discovered Live streaming room | express delivery | placing an order
After the 6-pound 3J cherries purchased for 199 yuan arrived, Ms. Wang, who lives in Shanghai, happily opened the package and found only a box of more than ten rotten fruits inside. When she tried to argue with the merchant, she found that the fan group she had ordered had been disbanded. Recently, the People's Procuratorate of Songjiang District, Shanghai has filed a public prosecution against this Chelizi fraud case in accordance with the law.
In January of this year, Ms. Wang saw an advertisement in a live broadcast room on a certain platform and placed an order for 6 pounds of 3J cherries through the fan group of the live broadcast room for 199 yuan. However, a few days later, she only received a dozen rotten fruits in the delivery box. Because the merchant had promised to compensate for any damages, Ms. Wang was preparing to exchange the goods with the merchant. It was only then that she realized that the fan group that had placed the order had already been disbanded. A few days later, she joined the buyer rights protection group and worked with dozens of victims across the country to provide the police with information about being scammed. In February of this year, the criminal gang responsible for the crime was arrested by the police.
After Lin, the leader of the criminal gang, arrived at the case, he had many excuses about his criminal behavior, but other members truthfully explained the operation mode of the gang. According to the members of the gang, from early November 2022 to the end of January 2023, Lin rented a venue in an office building in Fujian for live streaming "selling" cherries. He recruited Wu as the operational manager for the preliminary preparation work. Before starting the live broadcast, the operator will purchase multiple accounts of the live broadcast platform and use various methods to "keep accounts". After the account's credit reaches a certain rating, it will be used to open a live broadcast room. Generally, a new account will be used every two to three days for live streaming. Lin's anchor Wang is responsible for promoting products in the live broadcast room, with language such as "2J imported cherries weighing 5 pounds and 99 meters, free shipping, and compensation for bad fruits" and "3J imported cherries weighing 199 meters, buy 5 pounds and get 1 pound free, free shipping, and compensation for bad fruits". The price is much lower than the market price of this quality cherries, which is highly attractive. At the same time, Lin will also direct the operation of the team to use technical means to attract more viewers into the live broadcast room.
When there are a large number of viewers in the live broadcast room, anchor Wang will follow Lin's instructions and tell fans in the live broadcast room that only by joining the fan group can cheap cherries be purchased, inducing interested viewers to join the fan group. In the fan group, others are not allowed to speak, only members of the gang will post reminder messages every few minutes and send order QR codes to lure customers into placing orders. In fact, the webpage that the customer scans the QR code and redirects to is not the official platform store, but a phishing website that looks very similar to the platform store. The money paid by the customer on this phishing website will be transferred to Lin's personal account. Therefore, after placing an order on the website, customers will not generate an order on the platform, and many consumers have also discovered this. However, when they went to defend their rights, the fan group had already disbanded.
According to gang members, after customers place orders, the boss will randomly ship some consumers, but the express package only contains 0.1-0.2 kilograms of poor quality cherries. Similarly, when customers want to protect their rights, they will find that the fan group they ordered has already been disbanded.
Gang members remind their relatives and friends not to make purchases
Gang operator Wu stated that in the later stage of the live broadcast, people often leave messages on the public screen saying "scammers", "do not ship", "do not buy", etc. During the live broadcast, he is also responsible for kicking out the person who said these words and blacklisting them. Other members of the gang have also reminded their friends through WeChat not to buy such cherries in the live broadcast room, as they are all scams. Therefore, members of the gang are subjectively aware of their fraudulent behavior.
In June this year, the case was transferred to the Songjiang Procuratorate for review and prosecution. The prosecutor in charge introduced that based on the current situation, the amount involved in the gang is over 21000 yuan, which has reached the standard of a relatively large amount of fraud. Criminal responsibility should be pursued in accordance with the law. Therefore, the main members of the gang, Lin, Wang, and Wu, were prosecuted.
