How to resolve a dispute that lasts for 3 years?, The prosecutor ran to the community to hold a hearing on women's assistance
We are prosecutors from the Fifth Prosecutor's Department of the Second Branch of the Shanghai People's Procuratorate. Today, we held a simple on-site hearing in accordance with the law regarding the case where Cheng refused to accept the court's civil judgment and applied for supervision to this court. Recently, a public hearing on a case of excluding obstruction disputes was held in a residential community. Through the efforts of the prosecutor, Cheng was helped to solve the long-standing problem.
This year marks the 60th anniversary of Comrade Mao Zedong's instruction to study and promote the "Maple Bridge Experience" and the 20th anniversary of General Secretary Xi Jinping's instruction to adhere to and develop the "Maple Bridge Experience". The Second Branch will practice the "Maple Bridge Experience" of the new era as a test of the effectiveness of thematic education. A key task.
In 2020, a new homeowner named Cheng planned to install four protruding anti-theft windows in his own window, but was stopped by relevant management personnel when assembly components and materials were transported into the community. So Cheng sued the property management company and town government in court, demanding the removal of obstacles and compensation for losses. After going through the first trial, second trial, and retrial, Cheng's lawsuit was not supported by the court and he applied for supervision from the procuratorial organs. After reviewing the case, the prosecutor believes that the court ruling is not inappropriate.
The case seems to have ended, but the problems encountered by Cheng have not been resolved yet. The window cannot be installed, and the purchase cost still needs to be covered by Mr. Cheng. As a result, he had an unpleasant relationship with the anti-theft window merchant, which led to resentment towards the outcome of the case. In order to further resolve the conflicts involved in the case, the prosecutor in charge of the Second Branch invited experienced people's mediators to participate in the case mediation and serve as hearing officers. They allowed the anti-theft window merchant who had been continuously requesting the final payment from Mr. Cheng for many years to participate as an outsider in the mediation, and finally resolved the conflicts between the parties. The relevant settlement agreement was successfully signed and fulfilled, and Mr. Cheng voluntarily withdrew his supervision application. He also sent a thank-you letter to the Second Branch to express his respect for the prosecutor.
In recent years, the Second Branch has always adhered to the principle of putting the people at the center, continuously improving its ability to uphold justice, remedy rights, ensure security, and provide services. Since the launch of the theme education, members of the leadership team led by Tao Jianping, Secretary of the Party Group and Prosecutor General of the Second Branch, have repeatedly gone deep into the front line to ask questions and plans through methods such as "four no's and two's" and "supervision style", focusing on relieving the worries, troubles, and worries that linger in the minds of the people, and effectively transforming the achievements of the theme education into practical matters related to people's livelihood.
Not long ago, the Second Branch, together with the Jing'an District Prosecutor's Office and the Jing'an District Women's Federation, jointly signed the Implementation Opinions on Strengthening National Judicial Assistance for Women in Difficulties. Based on the functional advantages of all parties, it comprehensively promoted the special work of judicial assistance for women in difficulties, optimized the social environment for their lives and development.
The opinion clarifies the rescue targets and task division, and lists 8 types of difficult women who have suffered from illegal and criminal acts such as domestic violence, are seriously ill, and have lost their ability to work as key targets. We will increase the rescue and assistance efforts based on individual circumstances. It is clear that the procuratorial organs will actively investigate the clues of women who meet the conditions for assistance in handling cases, inform them of the application channels for assistance, assist in applying for judicial assistance, and the district women's federation will provide psychological counseling, legal counseling, and other services. Both parties will jointly carry out psychological counseling, economic assistance, family education guidance, and other work. The branch and district hospitals will also strengthen their integration and linkage, relying on the advantages of local connections of the district hospitals to carry out judicial assistance work. Through joint meetings, in person training, and other forms, they will discuss difficult issues related to women's rights protection and research forward-looking topics with the district women's federation to improve their professional level. They will also work together to carry out tracking and evaluation, follow-up visits and condolences for women in need, coordinate professional forces from departments such as civil affairs, education, and the Disabled Persons' Federation, provide diversified assistance such as vocational skills training and psychological counseling, forming a synergistic effect and improving the effectiveness of assistance.
