Being sued in court for repayment of money?, A woman mortgages a house in Shanghai and lends her best friend's husband over 5 million yuan to do business with a bank card | Ms. | Best friend
Is it clear that one lent more than 5 million yuan to others, but was sued by the other party in court for repayment? Although she won the lawsuit, the more she thought about it, the angrier Ms. Yan still chose to report it to the police. Recently, after being prosecuted by the People's Procuratorate of Qingpu District, Shanghai, the court sentenced the defendant Yao to one and a half years in prison and a fine of 100000 yuan for the crime of false litigation.
In 2012, Yao met his wife's best friend, Ms. Yan. Coincidentally, Yao and Ms. Yan were both in the same industry, but the difference was that Yao had just entered the industry, while Ms. Yan had been in business for many years and had developed her career very well. Because Yao is a good friend's husband, Ms. Yan takes many photos of him in her daily business and quickly introduces him to a project order. Yao did not have enough start-up funds, so he secretly borrowed money from Ms. Yan without telling his wife. Ms. Yan agreed and handed over one of his credit cards to Yao for use.
Yao was also polite. After using this card to cash out hundreds of thousands, he still felt that it was not enough. He gradually borrowed two credit cards from Ms. Yan and borrowed an additional 3.1 million. Afterwards, Yao transferred the money from his credit card repayment directly to Ms. Yan's bank account every month, and then Ms. Yan would be responsible for the repayment. In 2013, Yao requested Ms. Yan to mortgage a property under her name to a bank for a loan, citing a lack of funds. The borrower was Yao, and Ms. Yan was the guarantor. After Ms. Yan followed suit, she handed over the 2 million yuan obtained from the mortgage loan to Yao for use. Out of trust, Ms. Yan did not make many reminders and did not force Yao to repay the money in the face of his excuses.
To Ms. Yan's surprise, in 2017, she was sued by Yao. What's even more outrageous is that Yao transferred monthly funds to Ms. Yan's bank account as evidence for repaying her credit card, claiming that he had been borrowing more than 5.6 million yuan from Ms. Yan for many years to work on a project. However, Ms. Yan refused to repay the loan and had to sue the court to demand that Ms. Yan repay the loan and pay the corresponding interest.
On July 24, 2017, the court held a trial of a civil case filed by Yao against Ms. Yan. Due to doubts about the evidence, the court ruled to dismiss Yao's lawsuit request. Although they won the lawsuit, their relationship completely broke down. Ms. Yan reported to the public security organs in March 2021 after several unsuccessful attempts to recover her outstanding debts. In May 2022, this case was transferred to the Qingpu Procuratorate for examination and prosecution. After Yao arrived at the case, he confessed that he was in financial difficulties during the construction period. Ms. Yan accidentally urged him to pay a debt, which made him dissatisfied. He then fabricated facts and filed a civil lawsuit.
